I hadn’t had any luck finding John Cerino the day before, so I started in Dunnville this time. He wasn’t at the McDonald’s so I went to 1012 Cedar Street. Here’s the beginning of what happened.

Note that I served John with the Notice of Contempt at 1:05 in the video, after which he closes the door. When I turned to leave and started walking away, he opened the door and came out after me. He then grabbed for the cell phones I was using to record service (there were two, both with cameras running, placed front to front. I do that so the position of the camera can be established. John has made many false claims of a “camera stuck in my face”. The other videos clearly show John was violating my personal space and grabbed at the cameras. Note also John’s homophobic slur.

There were other videos made, but this incident is currently before the courts. Johns story was that I attacked him by striking him with a cell phone. I hadn’t, and the injuries to the top of my skull where John had struck me with something (presumably the cell phone he had in his hand when he came out of the door) and the injury to my throat were quite obvious. John had applied a (perfect) naked choke, after a (perfect) scissor leg takedown. That was the first indication I had that John has martial arts training.

Well, so do I.

When John first struck me on the top of the skull, I countered by placing my left hand over my skull. John then applied the naked choke, applying pressure to my carotid and windpipe. I countered that by bending his pinkie backwards. It didn’t work, so I broke the finger. That didn’t work either; it turns out that John has incredibly strong hands and a high tolerance for pain. It did move his forearm away from my throat enough for me to drop my chin and take a bite out of his arm. That caused John to break the choke and he began hammering on the top of my skull, while he had me pinned to the ground. He then tried to reappy the chokehold, but stopped when I went for another bite from his arm.

My skull is pretty thick, that didn’t have much effect.

The rest of this story will have to wait until John’s trial. He was charged two days later with offences under Section 267(a) and 267(c) of the criminal code. He should also have been charged with an offence under Section 246 of the criminal code, but it appears the Crown Attorney assigned to the case has microscopic balls a reluctance to pursue charges against John Cerino. (A Lawyer might understand that, but for the readers who aren’t members of the legal tribe, Section 246 of the Criminal Code is straight indictable. That would mean a jury trial for John. Apparently there aren’t enough court resources in Dunnville to pursue the correct charge.)

As an added bonus, John picked up my glasses and walked off with them at the end of all this. The man in an unrelenting asshole. However, the bulging shirt pocket stuffed with papers spilled all over the ground, along with some of the papers I had in my pocket. When I picked my stuff up later, I got some of John’s paperwork, including a notebook that was very informative about his life and finances. That may come in handy later.)

Later that evening, Constable Whittall sent a link to upload the videos from my phone. The portal used by OPP for this purpose is virtually useless when working from a mobile device, btw, so if you ever find yourself in a position where you have to upload video evidence to the OPP, use your desktop.

There was no response to my texted question at the end.
